1. OVERVIEW
1.1 Agreement
These Terms of Service ("Terms") govern your use of MRTZ and all associated applications including but not limited to DareDog, FairwayFlow, HeyCaddie, Hyzerlyzer, and MRTZ Hub (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1.2 Eligibility
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you meet this requirement.
1.3 Modifications
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Services after changes constitutes acceptance of the modified Terms.

2. MRTZ IS NOT GAMBLING
2.1 No Monetary Value
MRTZ has absolutely no monetary value whatsoever. This is the fundamental characteristic of MRTZ and the foundation upon which all Services are built.
- You CANNOT purchase MRTZ with real money. There is no way to buy MRTZ.
- You CANNOT sell MRTZ for real money. There is no marketplace, exchange, or cash-out feature.
- You CANNOT convert MRTZ to any currency or asset. MRTZ exists solely within the Services ecosystem.
- You CANNOT transfer MRTZ outside the Services. MRTZ only moves between user accounts within approved transactions.
2.2 Social Accountability Only
MRTZ serves one purpose: tracking social accountability between friends. When you "stake" MRTZ on a challenge:
- You are tracking a social commitment, not placing a bet
- The outcome affects your MRTZ balance, which has no monetary value
- You are not wagering anything of value
- No money, goods, or services of monetary value are exchanged through the platform
2.3 Legal Distinction from Gambling
Gambling requires wagering something of monetary value on an uncertain outcome. MRTZ explicitly lacks monetary value, therefore activities using MRTZ do not constitute gambling under applicable law. Users acknowledge and agree that:
- MRTZ challenges are equivalent to keeping score in a game
- MRTZ balances are similar to "points" in a game with no cash value
- The Services do not facilitate, promote, or enable gambling
2.4 Real-World Settlements
The Services do not track, facilitate, enforce, or have any involvement in real-world settlements between users.
If users independently choose to make personal arrangements outside the Services (such as buying drinks for a friend), those arrangements:
- Are entirely separate from and unconnected to the Services
- Are not recorded, tracked, or monitored by the Services
- Are not enforced or facilitated by the Services
- Are the sole responsibility of the users involved
- Have no connection to MRTZ or any feature of the Services
2.5 Prohibited Monetary Activity
Users are strictly prohibited from:
- Attempting to buy or sell MRTZ for money
- Creating any secondary market for MRTZ
- Advertising or promoting MRTZ as having monetary value
- Using the Services to facilitate actual gambling
- Misrepresenting the nature of MRTZ to others
Violation of this section will result in immediate account termination and permanent ban from all Services.
3. MRTZ TERMS
3.1 MRTZ Balance
Your MRTZ balance represents your accumulated social merit within the ecosystem. It reflects your track record of keeping commitments, contributing value, and participating in challenges.
3.2 Earning MRTZ
MRTZ can be earned through:
- Winning challenges on DareDog
- Contributing validated course data on FairwayFlow
- Winning side games on HeyCaddie
- Validating others' contributions
- Initial sign-up bonus (one-time)
3.3 Spending MRTZ
MRTZ can be spent through:
- Staking on challenges (DareDog)
- Side game entry (HeyCaddie)
- Coach reviews (Hyzerlyzer)
- Dispute stakes (FairwayFlow)
3.4 Transfer Limitations
MRTZ can only be transferred through official mechanisms within the Services (e.g., challenge settlements, side game outcomes). Direct user-to-user transfers may be subject to a processing fee and daily limits.
3.5 Balance Decay
To encourage active participation, accounts with very high balances (above 5,000 MRTZ) may be subject to a 1% monthly balance decay.
3.6 Negative Balance
MRTZ balances may go negative up to -500 MRTZ to allow continued participation. Users with negative balances may have limited access to certain features until their balance is restored.
3.7 No Ownership
MRTZ is not property. Users do not "own" MRTZ in any legal sense. MRTZ represents a metric within the Services that can be modified, adjusted, or removed at our discretion.
4. ACCEPTABLE USE
4.1 Permitted Uses
The Services are intended for:
- Creating and participating in friendly challenges with people you know
- Tracking scores and side games during recreational activities
- Contributing to and using community course data
- Analyzing and improving personal athletic performance
4.2 Prohibited Uses
Users may NOT:
- Use the Services to facilitate actual gambling or wagering of money/goods
- Create multiple accounts to manipulate MRTZ balances
- Collude with others to artificially transfer MRTZ
- Submit false or misleading challenge outcomes
- Submit fraudulent or inaccurate course data
- Harass, threaten, or abuse other users
- Use automated tools or bots
- Attempt to reverse engineer or hack the Services
- Scrape or mass-download data from the Services
- Resell or commercially exploit any data from the Services
4.3 Enforcement
Violations may result in:
- Warning
- MRTZ balance penalties (DMRTZ)
- Temporary suspension
- Permanent account termination
- IP blocking
- Legal action where appropriate
5. PRIVACY POLICY
5.1 Data Collection
We collect the following data to operate the Services:
- Account Information: Email address, display name, authentication credentials
- Activity Data: Challenge history, MRTZ transactions, game scores
- User Content: Photos, course data, and other content you submit
- Device Information: Device type, operating system, app version
- Usage Analytics: How you interact with the Services (anonymized)
5.2 Data Use
We use your data to:
- Operate and improve the Services
- Process challenges and maintain MRTZ balances
- Communicate with you about your account
- Prevent fraud and enforce Terms
- Aggregate anonymized usage statistics
5.3 Data Sharing
We do NOT sell your personal data to third parties. We may share data with:
- Service providers who help operate the Services (under strict confidentiality)
- Other users (only your public profile and challenge history)
- Law enforcement when legally required
5.4 User Content Ownership
Content you submit (photos, course data, etc.) becomes property of the Services. By submitting content, you grant us a perpetual, worldwide, royalty-free license to use, modify, and distribute that content within the ecosystem.
5.5 Data Retention
We retain your data for as long as your account is active. You may request account deletion at any time, which will remove your personal data (though anonymized contributions may remain).
5.6 Security
We implement industry-standard security measures to protect your data. However, no system is perfectly secure, and we cannot guarantee absolute security.
6. CHALLENGE DISPUTES
6.1 Resolution Process
When users disagree on challenge outcomes:
- A 48-hour dispute window opens
- Both parties may submit evidence or explanation
- If agreement is not reached, the MRTZ is voided and returned to both parties
6.2 No Arbitration
We do not arbitrate disputes between users. The Services track MRTZ, not right or wrong. If users cannot agree, no MRTZ changes hands.
6.3 Fraud Prevention
We may investigate patterns of disputed challenges. Accounts that consistently create disputes or exhibit suspicious activity may be subject to enforcement action.
7. GENERAL TERMS
7.1 Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UPTIME, ACCURACY, OR AVAILABILITY.
7.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
7.3 Indemnification
You agree to indemnify and hold harmless MRTZ and its affiliates from any claims arising from your use of the Services or violation of these Terms.
7.4 Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.
